These Terms of Service govern your access to and use of KIM — Kitchen Intelligence Manager — a software platform provided by The Chef's Twist. By accessing or using KIM, you agree to be bound by these terms. If you do not agree, do not use the platform.
KIM is a subscription-based software platform that provides visual AI diagnostic assessments for commercial and institutional food-service environments. Users submit photographs of kitchen and bar environments; KIM processes those inputs using artificial intelligence to generate structured operational assessments covering compliance, inventory, workflow, and cost exposure.
KIM is operated by The Chef's Twist, a Las Vegas-based culinary operations company.
Subject to these Terms and payment of applicable subscription fees, The Chef's Twist grants you a limited, non-exclusive, non-transferable, revocable license to access and use the KIM platform during an active subscription term solely for your internal business operations.
This license does not include the right to sublicense, resell, copy, reverse-engineer, or create derivative works based on the KIM platform, its methodology, scoring systems, or underlying technology.
You must be at least 18 years old and operating or authorized to represent a legitimate food-service business to use KIM. By using KIM, you represent that you meet these requirements and have the authority to bind your organization to these terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
Access to KIM requires an active subscription. Certain features may only be available on specific subscription plans. We reserve the right to suspend, restrict, or terminate access to the platform for violation of these Terms or conduct that we determine, in our sole discretion, is harmful to the platform or other users.
KIM is offered on a subscription basis. Current subscription pricing is published on our website and may be modified from time to time with reasonable notice to active subscribers.
Subscriptions renew on a monthly basis unless cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial subscription periods.
We strive to maintain platform availability but do not guarantee uninterrupted or error-free access to KIM. We may perform scheduled or emergency maintenance that temporarily affects availability. We are not liable for any losses arising from platform downtime or interruptions.
We may add, modify, remove, or discontinue platform features, integrations, scoring methodologies, and functionality at any time. We will endeavor to provide reasonable notice for material changes that affect active subscribers.
You agree to use KIM only for its intended purpose — operational assessment of food-service environments you own, operate, or are authorized to assess. You agree not to:
You retain ownership of content you submit to KIM, including photographs, operational data, intake information, and related materials ("Customer Content").
By submitting Customer Content to KIM, you grant The Chef's Twist a perpetual, irrevocable, worldwide, transferable, sublicensable, royalty-free license to store, process, analyze, reproduce, modify, create derivative works from, aggregate, anonymize, benchmark, and otherwise use such content for the operation, improvement, development, training, testing, marketing, and commercialization of KIM and related products and services.
You acknowledge that anonymized and aggregated operational data, insights, benchmarks, model outputs, and derivative datasets generated through KIM are the exclusive property of The Chef's Twist. This includes but is not limited to industry benchmarks, scoring models, operational intelligence layers, and training datasets derived from platform usage.
You represent that you have the right to submit all Customer Content you provide to KIM and that doing so does not violate any third-party rights or applicable law.
KIM offers optional integrations with Square and Clover point-of-sale systems. Both integrations are live, deployed, and operate under the same principles.
When you connect a Square or Clover account, you authorize KIM to access specific read-only data from that account — including merchant profile, inventory, catalog, and team data — as described in our Privacy Policy. The specific data accessed varies slightly by platform and is detailed in full in the Privacy Policy.
KIM's access to both Square and Clover accounts is read-only. KIM cannot and does not modify, delete, or write to your POS data on either platform. This is enforced at the API level by both Square and Clover.
You may disconnect either integration at any time through your KIM portal or directly through your Square or Clover account settings. Disconnecting does not delete your existing scan records. POS integrations are optional; KIM functions without a connected POS account.
KIM may support additional POS integrations in the future. When new integrations are added, this section and the Privacy Policy will be updated accordingly.
KIM uses artificial intelligence and machine learning models to generate operational assessments. Outputs may contain errors and should be independently evaluated by the user before acting on them.
KIM's assessments are advisory in nature and are intended to support operational decision-making, not replace professional judgment. You remain solely responsible for compliance with applicable health codes, safety regulations, and operational standards in your jurisdiction.
KIM's health code analysis is developed in alignment with Southern Nevada Health District (SNHD) standards for Las Vegas-area operations. Assessments for operations in other jurisdictions may not fully reflect local regulatory requirements.
KIM, including its diagnostic methodology, scoring engine, report formats, AI models, and underlying software, is the proprietary intellectual property of The Chef's Twist. KIM is the subject of a pending USPTO provisional patent application (Application #64/018,511).
Nothing in these Terms grants you any rights in KIM's underlying technology, methodology, or intellectual property beyond the limited license described in Section 2.
We treat your operational data as confidential. We do not share your scan results, business data, or POS data with third parties except as required to operate the platform or as required by law. See our Privacy Policy for complete details.
KIM is provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, completeness, fitness for a particular purpose, or reliability of KIM's assessments or platform availability.
We are not liable for any regulatory action, health code violation, or operational failure that occurs notwithstanding use of KIM.
To the fullest extent permitted by law, The Chef's Twist shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of KIM. Our total liability for any claim arising out of your use of KIM shall not exceed the amount you paid us in the three months preceding the claim.
These Terms are governed by the laws of the State of Nevada. Any disputes arising under these Terms shall be resolved in the courts of Clark County, Nevada.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will notify active subscribers by email with reasonable advance notice. Continued use of KIM after changes take effect constitutes acceptance of the updated terms.
